Difference between Chapter 7 and Chapter 13: Fresh Start v Reorganization
Why file a Chapter 13: (1) too much income, (2) too much non-exempt property, (3) previous filings have not passed the required time between cases filed, (4) stop a foreclosure, and (5) voluntarily want to be in a Chapter 13.
Why file a Chapter 7: (1) qualified income allows you to file Chapter 7, (2) stop a garnishment, (3) not delinquent on secured debts (house, car, etc), and (4) have NO back taxes, car payments, home mortgage, or other delinquency on secured property.
The "fresh start," is the most common form of bankruptcy.
$50 non-refundable deposit is used to purchase a credit report for an individual ($100 for a married couple), which is then applied to your attorney fees.
You must provide your Social Security number and picture ID.
If you are having trouble with your finances, bankruptcy might be the best solution for you.
